Terms of Service (Café GotSoul)

These Terms of Service (“Terms”) govern your access to and use of the Café GotSoul website (the “Site”) and any purchases you make through our online store. By using the Site or placing an order, you agree to these Terms.

1) About Us

The Site is operated by Café GotSoul (“GotSoul,” “we,” “us,” “our”). We currently sell apparel and art prints through our ecommerce store.

2) Eligibility & Acceptable Use

By using this Site, you confirm that you are at least the age of majority in your place of residence (or have permission from a parent/guardian). You agree not to misuse the Site, attempt unauthorized access, or interfere with the Site’s security or operation.

3) Products, Descriptions & Availability

We aim to display products accurately, including descriptions, sizing, and images. However:

• Colors may vary due to device/screen settings.

• Availability may change at any time.

• We may limit quantities per customer and may refuse or cancel orders where we suspect fraud, unauthorized activity, or resale abuse.

4) Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, or cancel any order for reasons including (but not limited to):

• Product unavailability,

• Errors in pricing, descriptions, or listings,

• Inability to verify payment, billing, or shipping information,

• Suspected fraud or unauthorized activity.

If an order is cancelled after payment is processed, we will issue a refund to the original payment method.

5) Pricing, Currency & Payments

All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Taxes and shipping charges are calculated at checkout.

We may change prices at any time. Price changes do not affect orders already confirmed. If we discover an error in pricing or product information, we may cancel the order and refund you.

6) Shipping

7) Returns & Refunds

Returns and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms. Please review it before purchasing.

8) Art Prints: Variations & Care

Art prints should be handled with care. Minor variations in color may occur between what you see on screen and the printed product. If your print arrives damaged or defective, contact us promptly in accordance with our Returns & Refunds Policy so we can resolve it.

9) Intellectual Property

All content on the Site—including designs, logos, product photos, graphics, text, and artwork—is owned by Café GotSoul or used with permission and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written consent.

10) Promotions & Discount Codes

Promotions and discount codes:

• Must be applied at checkout (cannot be applied retroactively),

• May have restrictions, limits, or expiration dates,

• Have no cash value and cannot be redeemed for cash,

• May be limited to one per order unless stated otherwise.

11) Third-Party Links & Services

The Site may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.

12) Disclaimers

To the extent permitted by law, the Site and all products are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, secure, or error-free.

13) Limitation of Liability

To the maximum extent permitted by law, Café GotSoul will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.

To the extent permitted by law, our total liability for any claim related to an order will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any disputes, claims, or proceedings arising out of or relating to these Terms, the Site, or your purchase will be brought exclusively in the courts located in Quebec, Canada, and you submit to the jurisdiction of those courts.
